Terms of Service

1. Agreement to Terms

By accessing or using Event Passport PRO ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms apply to all visitors, users, event organizers, and others who access or use the Service.

2. Description of Service

Event Passport PRO is a SaaS platform that enables event organizers to create gamified check-in experiences. The Service includes QR code stamp passports, digital leaderboards, attendee networking, sponsor showcases, agenda management, and associated mobile applications and web tools.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where required by law.

3. Accounts and Registration

To use certain features you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your account credentials secure and not share them with third parties
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

You must be at least 13 years of age to create an account. By creating an account, you represent that you meet this requirement.

4. Subscriptions and Billing

Certain features of the Service are available on a subscription basis. By subscribing, you agree to pay the applicable fees as described at the time of purchase.

• Billing cycle: Subscriptions are billed monthly or annually depending on the plan selected. Fees are charged in advance.
• Automatic renewal: Subscriptions automatically renew unless cancelled before the renewal date.
• Cancellation: You may cancel your subscription at any time. Access continues until the end of the paid billing period.
• Refunds: Fees are generally non-refundable except where required by applicable law. Contact us at hi@eventpassportpro.com if you believe a refund is warranted.
• Price changes: We will give you at least 30 days' notice before changing subscription prices.

Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Transmit spam, unsolicited messages, or fraudulent content
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to any portion of the Service
• Collect or harvest personal data of other users without their consent
• Use the Service for any unlawful, harmful, or abusive purpose

We reserve the right to suspend or terminate accounts that violate these guidelines, with or without notice.

6. Content and Data

Your content: You retain ownership of any content you submit to the Service (event details, attendee data, logos, etc.). By submitting content, you grant us a limited, non-exclusive license to use it solely to operate and provide the Service.

Attendee data: Event organizers are responsible for obtaining any necessary consents from attendees for the collection and processing of their personal data through the Service. Organizers act as independent data controllers for their attendees' data. We process this data on your behalf as a data processor under the terms of our Privacy Policy.

Our content: The Service and its original content, features, and functionality are owned by us and are protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

7. Privacy and Cookies

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your information.

We use cookies and similar tracking technologies on our website. Non-essential tracking cookies (used for analytics and advertising) are only placed with your explicit consent, which you can manage via the cookie banner shown on your first visit.

If you are located in the European Economic Area (EEA) or United Kingdom, we process your personal data in accordance with the General Data Protection Regulation (GDPR) and applicable local laws. 8. Third-Party Services

The Service integrates with third-party services including Stripe (payments), Resend (email), Cloudflare (storage), and analytics tools. Your use of these integrations is subject to those providers' own terms and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any information provided through the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

Nothing in these Terms limits liability that cannot be excluded by law (including liability for death or personal injury caused by negligence, or for fraud).

11. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the courts of competent jurisdiction.

If you are an EU consumer, you may also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, notify you by email or a prominent notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
